Terms & Conditions
A list of Terms and Conditions regarding commissioning a pet portrait or other piece of artwork from Amanda Drage Art. Please make sure you read through these points carefully, and that you agree to them, if you are interested in commissioning artwork.
Payment of a deposit signifies your agreement to the following Terms and Conditions.
Deposits for Portraits and other Commissioned Artworks
On booking a commissioned artwork, a deposit payment of 25% of the cost of the artwork is required. This is non-refundable to cover the artist's costs, except where the artist is unable to complete the work due to unavoidable change in their circumstances.
Additional Charges for Portraits and other Commissioned Artworks
Prices for commissioned work are as listed on the Pricing page; however, anything that increases the preparation or working time considerably will need to be charged accordingly.
Any time that an additional charge may be required during the process, clients will be made aware clearly, and at the soonest opportunity. Additional charges will never be incurred without the prior agreement of the client.
An additional charge will need to be applied under the circumstances listed below.
Photo Composite Charge - In most instances I am able to work from just one or two photos. When photos must be combined in a more complex way to create a suitable portrait, or a new pose must be devised from a combination of several reference photos (eg. using different photos for the head, body, legs of the subject), this charge will apply.
Photo composite charges will be calculated in proportion to the extent of extra time and work required, at the discretion of the artist.
Extra Elements Charge - My standard Pricing is based on a bust or full body portrait of one or more animal subjects. Backgrounds, or other "extra elements" (such as a large patch of grass, or an object which will take up considerable space on the paper or canvas), will warrant an extra charge.
As of 2020 this will be charged at £25 per hour.
Alteration Charge - I make every effort to ensure the client is happy with all aspects of the proposed piece before I begin by creating initial sketches and mockups, and throughout the process of the portrait by providing regular updates and photos of its progress. However sometimes certain aspects need reworking during the process.
Many alterations are easily fixed (eg hue changes). These are classed as minor alterations, and no extra charge is necessary.
Should any major alterations (eg structural changes) be required once work has begun, the time taken will warrant an extra charge.
Flat rate is £25 per alteration. More extensive alterations will be at higher cost.
Photo Session Charge - If a photo session by the artist is required in order to obtain reference photos for a pet portrait, the cost will be £20, for up to one hour.
If additional time is required this will be charged at a rate of £15 per hour.
Travel costs per mile to cover fuel will also apply. This can be discussed and agreed on upon booking.
Payments and Postage of Work
The final balance of payment is due on completion of the work. Clients are to pay the final balance within one week of the completion date, unless another payment date has been discussed and agreed prior.
Where payment cannot be completed in this time, an extension may be granted, at the artist's discretion.
In the case of installment payments, where payment cannot be completed within the agreed time period, an extension may be granted at the artist's discretion.
Under no circumstances will any work be posted or shipped out until the whole payment (including the cost of postage/shipping) has been received in full.
In the unlikely event that a client is completely unhappy with a commissioned artwork, and the artist is not able to adjust the work to the client's satisfaction, the order can be cancelled. The artist retains the right to keep the deposit (no more than 25% of the cost of the portrait) to cover a portion of the time spent on the work, and materials costs.
The outstanding payment will be cancelled, and any installment payments made outside of the 25% deposit will be refunded.
Non-completion of Payments
If payment is not completed in the agreed time period inclusive of any agreed extension, and the work is complete, the sale will be cancelled.
Any remaining monies to be paid will be cancelled. Any monies already paid will not be refundable.
If the client decides the piece is no longer wanted or required and work has begun, the artist reserves the right to keep the deposit (25% of the cost of the portrait) to cover a portion of the artist's time and costs.

Customs and associated shipping charges
Artworks shipped to countries outside of the UK (including countries within the EU) may be subject to customs and import charges. Please check the import rules for your country and ensure you are happy to pay any duties incurred on delivery before booking a portrait. The artist is not responsible for nor has any control over import charges.
Postal Damage and Loss
Should an artwork suffer damage in the time period between it leaving the hands of the artist at the post office, and being received by the client (i.e. in the postal system), photographs of the damage must be emailed to the artist, so that the possibility of repair can be assessed. If repair is possible, the artwork can be returned to the artist for repair free of charge. The artist will reimburse any costs the client pays for returning the artwork, and will pay for the repaired artwork to be posted back to the client.
If the damage is irreparable, and the artwork is a commissioned portrait, the artwork can be re-done free of charge. Although the artist will endeavour to carry out the replacement piece at the soonest convenience, please note that due to other commitments it may not be possible to do so straight away.
The above also applies if a commissioned portrait is lost in transit by the postal system on its way to the client.
If the lost or irreparably damaged artwork is an original painting (ie not a pet portrait done to specification), a replacement may not be possible. In this case, the buyer will be refunded.
The above only applies in relation to the postage of work from the artist directly to the client that paid for the work. The artist does not have any responsibility to repair free of charge any damage incurred after the work has been delivered to the client, nor is the artist responsible for any loss or damage incurred by subsequent entry into the postal system (e.g. work posted by the client to a third party).
Copyright and Use of Commissioned Images
Under all circumstances, the copyright of the finished artwork is retained by and remains with the artist.
The finished artwork may be used by the client for display and personal enjoyment only.
No prints or copies shall be made, or profit gained in any way, from the finished artwork by the client, without the express written permission of the artist.
The artist retains the right to use the image for advertising artistic services, through printed adverts (e.g. flyers) and digital/social media (e.g. website, Facebook).
(The artist is happy to keep images of commissioned work private or refrain from using them in any advertising, on request.)
Termination of the Work by the Artist
The artist reserves the right to terminate the commission agreement, either prior to commencing or during the process of carrying out the work, for any reason, including but not limited to repeated rudeness in correspondence, failure to accord with the above terms, unreasonable requests or demands to the artist, threatening language or behaviour, or any form of harassment.
Changes to these Terms & Conditions
The artist reserves the right to make reasonable revisions to these Terms & Conditions at any time.
Records are kept of all revisions and the dates they are implemented.
